Website Policy
1.1 The "JUV Activewear" website serves as a website and virtual store (hereinafter: "the Website") operated by JUV Israel Ltd. (Company No. 558457404) (hereinafter: "the Company"), offering a variety of sports products for sale in Israel and worldwide (hereinafter: "the Products").
1.2. For any question, clarification, or inquiry regarding the Website, orders, or products offered on it, please contact the Company's customer service via WhatsApp only at: 055-272-9963. The Company does not provide customer service via email, phone calls, SMS messages, or any other means of communication, except at its sole discretion.
1.3. The terms of use (hereinafter: "Terms of Use"/"Regulations") stated below shall apply to any action and/or use of the Website and any purchase made thereon and shall constitute a binding agreement for all purposes between the users and the Website management (hereinafter: "Website Management"/"Management"). A user who does not agree to these terms of use is requested not to use the Website. It is also clarified that browsing the Website and/or purchasing products on it constitutes the user's agreement to accept and act according to the Website's regulations and constitutes the user's declaration that neither they nor any party on their behalf will have any claim and/or demand and/or lawsuit against the Website and/or any of its owners and/or employees regarding the terms and instructions of use.
1.4. The Company reserves the right to change these terms of use from time to time, at its sole discretion, without the need for prior warning and/or notice to the user.
1.5. In these regulations, the feminine singular is used for convenience only, and this use also includes addressing in the masculine singular and/or plural.
Website Terms of Use
2.1. All prices appearing on the Website for the products are stated in New Israeli Shekels. Prices include VAT, as applicable by law, and do not include shipping fees. The Website management may update product prices from time to time and shipping rates, without any prior notice.
2.2. Product prices and shipping fees appearing on the Website are updated in real-time. However, it is clarified to the user that prices are updated "online" from time to time, and therefore there may be a temporary difference between the price at the time of product collection (appearing in the shopping cart) and the price appearing at the end of the ordering process. For the avoidance of doubt, it is clarified that the Website management will not be responsible for any liability arising from and/or related to the aforementioned price differences.
2.3. It is clarified that the Website management does not undertake to keep stock of all products whose images appear on the Website, and that the images on the Website are for illustration purposes only. It should be emphasized that there may be differences in colors and/or sizes and/or changes of these between the appearance of the product on the Website and the actual appearance of the product.
2.4. The Website management reserves the right to offer promotions, benefits, and discounts on the Website at its sole discretion. The Website management may also terminate these promotions, benefits, and discounts at any time, replace them, and/or change them, without any prior notice. Furthermore, it will not be possible to redeem multiple discounts or promotions.
Product Orders
4.1 Product purchases will be made by a registered customer by filling out an order form on the Website. It is clarified that filling in all details is a prerequisite for placing an order. To ensure the order is executed as quickly and smoothly as possible, all required details on the Website, including name, address, email address, phone number, and credit card number, must be provided accurately, otherwise, the Company cannot guarantee the fulfillment of the order.
4.2 Upon the user placing the order, the Website will check the credit card details, and only after the order is approved by the credit card company will the transaction be confirmed and the product shipped.
4.3. In the event that the transaction is not approved by the credit card companies, the user will receive an appropriate notification. To complete the purchase, the user will be required to contact customer service via WhatsApp only to arrange the credit card companies' approval for the transaction. It is clarified and emphasized that a transaction will be considered complete only after the user arranges the credit card companies' approval for the transaction. In such a case, shipping times will only be counted from the date of approval of the transaction by the credit card company. If the user does not arrange approval within 7 days from the date of receiving the notification of refusal by the credit card companies to approve the transaction, the Company shall be entitled to cancel the order.
4.4 Providing false information is a criminal offense, and anyone who does so is subject to criminal and civil legal proceedings.
4.5 For the avoidance of doubt, approval of a purchase transaction on the Website is subject to the product being in the Company's inventory at the requested delivery date and/or at the time of order. If it was not stated that the product is out of stock and the product was not removed from the Website until the order was placed, the Company will not be obligated to sell the product, and the user will not have any claim and/or demand in this regard for any type of damage, whether direct or indirect damage caused to the user and/or a third party. This is subject to the Website management returning to the user any amount paid, if indeed paid to the Company, and/or the Company canceling the charge if it was made. It is clarified that there may be situations where, although a certain item is displayed on the Website as being in stock, it is actually out of stock and cannot be supplied – in these situations, the transaction will be canceled, and the purchaser hereby waives any claim in this regard, subject to the refund of the amount paid to the Company by them.
4.6. The Website management may, but is not obligated to, display or send updates to the user via email, including content updates, information about its services and products, as well as services and products of others, promotions and innovations on the Website, as defined in Section 30a of the Communications Law (Bezeq and Services), 5742-1982.
4.7 The Company shall be entitled not to approve a customer's order for any reason and at its sole discretion.
4.8. More than one coupon code cannot be redeemed per order. Customers wishing to redeem a website credit / gift card will be asked to contact customer service via WhatsApp only.
Cancellations and Returns
5.1. Every user is entitled to cancel the transaction within 7 days in accordance with the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: "the Law"). It is clarified that the Law stipulates that cancellation will only be made if the product remains in its original packaging. The cancellation fee is 5% of the item's value or NIS 100, whichever is lower. It is emphasized that no monetary credit will be given for items for which no monetary consideration was paid, such as promotions and gift vouchers.
5.2. Accordingly, a refund will be given if the goods are returned to the Company's warehouse in their original packaging and if they have not been used. Every user acknowledges that they will bear the shipping costs.
5.3. It is clarified that the return of products after their condition has deteriorated while in the user's possession, including in the case of returning a damaged and/or faulty and/or spoiled and/or otherwise harmed product and/or whose packaging has been damaged and/or was assembled in the user's home changing its condition for the worse, is subject to the Website management's right to claim compensation for such. The Website management shall have the sole discretion regarding the condition of the returned product.
5.4. The Website management shall be entitled to cancel a transaction and/or sale, in whole or in part, if the offer contains a significant and obvious clerical error, whether in the product price or in the product description, or if it is found that there was a communication malfunction and/or a technical problem that prevented users from making proper use of the Website, or in the case of force majeure, or if the product is out of stock.
5.5 Exchange or return of items for which no monetary consideration was paid and which were received as gifts will not be possible. Furthermore, it will not be possible to choose the gift item in advance unless explicitly stated otherwise by the Website team.
Shipping and Delivery Times
6.1. The Website management will deliver any product purchased by the user on the Website (within the Green Line) with a shipping cost of NIS 30, all within the period specified on the product's sales page, unless otherwise stated.
6.2. Product and/or service delivery times as stated here and/or on the Website include only "business days", i.e., weekdays, from Sunday to Thursday, and do not include Fridays and Saturdays, holiday eves and holidays (intermediate days of a holiday) or the day the order was placed.
6.3 The Company will ensure the delivery of the product purchased on the Website to the address, as entered by the customer, and within the stated shipping period, unless explicitly stated otherwise and/or except for delays as mentioned below.
6.4. It is clarified that the Website management will not be responsible for any delay in product delivery, including, but not limited to, the following cases: force majeure including war, acts of hostility, epidemic, state of emergency and natural disasters, strikes by suppliers, services or goods required for the production supply and/or transportation of products, any reason beyond the control of the Website management and/or any reason related to the shipping operation.
6.5 Pre-order ("Pre-Sale") delivery times are up to 21 business days. I understand that the company is not obligated to deliver my entire order earlier.
Privacy Policy
7.1. The website user may choose to provide personal details to the website management such as height, weight, measurements, photos, etc. (hereinafter: "Personal Details"). It is hereby clarified to the user that there is no legal obligation for them to provide personal details, and the provision of details depends on the user's free will and consent, and is intended for control and service improvement purposes.
7.2. Upon registration to the website and also during the purchase of a product or service on the website, the user can approve receiving direct mail, notifications, and marketing publications via email and/or text messages (SMS).
The user knows that the information provided in this form, including contact details, is current and was provided of their own free will without any legal obligation to do so, and that the information collected about them within the website, as well as any data generated based on the analysis of such information, will be stored in the Company's database (hereinafter: "database"). The use of the data provided by the user and those collected about them will be made in accordance with the Privacy Protection Law, 5741-1981. This information will be used for managing and streamlining communication with them, for marketing, statistical and commercial purposes, conducting surveys and market research. The user knows that the information will be used by the Company as well as by companies lawfully holding the database. The information will be used by the website for sending marketing and/or advertising material, including regarding promotions and benefits, by direct mail and also by various media means including mail, email, SMS, telephone and/or any other means of communication, including regarding collaborations with third parties within the club. Any user who does not wish to receive marketing messages and communications may remove themselves at any time from the mailing list by clicking on the "Unsubscribe" button or, alternatively, by contacting customer service via WhatsApp only at 055-272-9963. The Company will make efforts to respond to inquiries within a reasonable time during business hours.
7.3. It is clarified that this site may use cookies (especially for registered and subscribed users) and internal statistical interfaces (Google Analytics) to maintain anonymous statistical records of users and analyze user traffic, browsing habits on the site, and analyze clicks and time spent.
Release from Liability
8.1. The Website, its content, and all services provided through it are all available to users "as is" and "as available". Use of the Website is at the user's sole risk.
8.2. Without derogating from the generality of the foregoing, the Website management shall not be liable for any responsibility, including, but not limited to: any responsibility arising from the availability, accuracy, timeliness, reliability, morality, or usability of the content on the Website, any representation regarding ownership and/or other proprietary rights, representations regarding non-infringement, representations regarding freedom and/or suitability for any purpose, representations arising from the course of trade and/or use.
8.3. The provisions of this section above shall apply, without derogating from the generality of the foregoing, also, but not limited to, with respect to any damage and/or liability and/or expense, of any kind, direct and/or indirect, that may be caused to you and/or to any other person and/or corporation as a direct and/or indirect result of any error, omission and/or defect in the content and/or any inaction, error, omission, interruption, delay in operation and/or defect in transmission, computer virus, spyware, communication failure, theft and/or damage to a record, unauthorized access and/or unauthorized modification of the record and/or its use, including, but not limited to, due to a cause based on contract, tort, negligence, defamation and/or any other cause, of any kind, under any law and/or agreement.
8.4. For the avoidance of doubt, it is clarified that the extent of the Website management's liability is limited to the cost of the product to the user only. All information appearing on the Website, including commercial offers and/or various publications by third parties (hereinafter: "the Information") regarding the various products, and in general, is general information only. The Website management will not be responsible for any damage, direct or indirect, caused to the user as a result of relying on information appearing on the Website and/or any other internal/external information source and/or using products sold by it.
8.5. While the Website management makes reasonable efforts to include accurate and up-to-date information on the Website, the Website management will not be responsible and does not make any representation regarding the accuracy of the information, and will not be liable and/or responsible for typographical or other errors and omissions from the content.
Intellectual Property
9.1. All intellectual property rights on the Website, including without limitation, copyrights, patents, trademarks and marks of any other type, trade names, design rights, moral rights, information rights, archive and broadcasting rights, publicity and marketing rights, models, trade secrets (hereinafter: "Intellectual Property Rights"), arising from and/or relating to the Website and/or the content, including, without limitation, all text, material and images on the Website, are the exclusive property of the Website management, or of a third party who has authorized the Website management to use it, and are protected as such by Israeli and international law.
9.2. With regard to the provisions of this agreement, it is forbidden to copy, distribute, publicly display, transfer, modify, process, reproduce, translate, sell, rent, or send to a third party the intellectual property rights on the Website, without prior written approval from the Website management.
9.3. There is no authorization and/or license and/or right to use the intellectual property rights of the Website management on the Website or in the content, explicitly or implicitly, without prior written approval from the Website management.
9.4. The Website may include names, company names, brands, registered or unregistered trademarks, service marks, and logos (hereinafter: "the Marks"). These Marks are the property of their owners. There is nothing on the Website, directly or indirectly, that constitutes authorization and/or license and/or grant of a right to use these Marks without the express written approval of the owners of the Marks and/or the rights holders in the Marks in connection with this use.
General Provisions
10.1. In case of any conflict or contradiction between the provisions of these terms of use and any other publications, the provisions of these terms of use shall prevail for all intents and purposes. Any information and/or representation provided in this regard, in any other way, shall not be valid, except for an explicit change of these terms of use and their publication.
10.2. Any waiver, refraining from action, or extension granted by the Website management shall not be considered a waiver of the Website management's rights under any law.
10.3. Customer Service
The Company's customer service is available via WhatsApp only at 055-272-9963. Contacting through other channels, including email, phone, social networks, or any other means of communication, does not constitute an official inquiry to customer service, and the Company does not guarantee a response through them.
Pre-sale
11.1 Pre-sale items from a new collection ("Pre-Sale") will be delivered within 21 business days from the order date. If the order includes items not from the pre-sale, these items will also have a delivery time of 21 business days. Items will not be shipped separately.
11.2 I understand that I am entitled to cancel the order before it is shipped and receive a full refund. After the order leaves the logistics warehouse, the company reserves the right to charge a cancellation fee.
11.3 During the pre-sale period, new collection items will be offered at a special price. The company reserves the right to discontinue this promotion and sell the items at full price after the pre-sale ends.
11.4 For the avoidance of doubt, the shipping date depends on the item's availability in the Company's warehouse.
11.5 An order, including pre-purchase items, can be canceled before the items are shipped from the Company's warehouse, and a full refund will be provided for this by contacting the Company's customer service via WhatsApp only. If such an order is canceled after the items have left the Company's warehouse, the Company reserves the right to charge a cancellation fee.
